It takes about ten minutes, and it beats guessing. We’re detailers, not lawyers, so treat this as a practical checklist.

  1. Find your documents

    Look in your closing papers or the resident portal for the covenants and the rules and regulations. Your management company can email them.

  2. Know they’re public record

    South Carolina’s Homeowners Association Act says an HOA’s governing documents have to be recorded with the county to be enforceable. Nexton, Cane Bay and Carnes Crossroads are on the Berkeley County side. The Ponds and Summers Corner are in Dorchester County.

  3. Search for five words

    Search the file for commercial, vendor, washing, nuisance and drain. Those sections hold anything that could apply.

  4. Ask in writing

    If the wording is unclear, send the manager a short note and keep the reply. A written yes ends any argument later.
